Danish employment is governed by employment contracts, statutory employment acts, holiday rules, tax withholding obligations and collective agreement norms. Denmark does not use one single labour code in the same way as some jurisdictions; the correct employment setup depends on worker category, collective agreement coverage, role, work location and immigration status. Payroll and tax are administered through Danish tax systems, ATP administers several labour-market schemes, and work permits for non-EU nationals are administered by the Danish Agency for International Recruitment and Integration (SIRI).

Employment contracts, fixed-term employment and worker classification

Employees should receive clear written employment terms covering employer, employee, role, workplace, salary, working time, holiday, notice, benefits, confidentiality, intellectual property and any mobility requirements. Fixed-term employment is permitted in Denmark. However, successive renewals of fixed-term employment must be justified by objective reasons. Repeated renewals should therefore be reviewed carefully, particularly where the role and employment relationship are effectively ongoing.

Worker classification is important. A contractor who works under client direction, follows fixed hours, uses client systems and performs long-term core work may be exposed to reclassification, tax, payroll and employment-rights issues. EOR employment can be a cleaner model where the company needs ongoing supervision, IP protection and operational control.

Working hours, rest and overtime

Denmark’s legal framework includes a maximum average working time of 48 hours per week, including overtime, calculated over a reference period. The standard full-time working week is commonly 37 hours under collective agreements or market practice, but the exact arrangement depends on contract and sector terms.

Employees are generally entitled to rest periods and weekly time off under working-time rules. Overtime, shift work, offshore wind rotations, standby and travel-heavy project work should be documented before employment starts so payroll and working-time controls match the actual assignment.

Minimum wage and wage setting

Denmark does not have a universal statutory minimum wage. Pay is normally determined by individual employment contract, collective agreement, sector norms and market practice. For EOR hiring, salary should be commercially credible for the role, seniority, work location, project conditions and any applicable collective agreement environment.

For non-EU work permits, SIRI also assesses whether salary and employment conditions correspond to Danish standards. A salary that is high enough for an immigration threshold can still require review against Danish wage norms for the occupation.

Holiday, leave and notice

Employees accrue 2.08 paid holiday days per month, equal to five weeks per holiday year. Danish holiday rules also require correct treatment of holiday pay, holiday allowance and timing of leave. For EOR employment, payroll setup should distinguish base salary, holiday accrual, holiday allowance and any project or travel allowances.

Notice periods depend on employee category, contract and any collective agreement. For many salaried employees covered by the Salaried Employees Act, employer notice increases with length of service from one month to up to six months. Employees commonly give one month’s notice, unless the contract or applicable rules provide otherwise.

Payroll tax, A-tax and labour-market schemes

Danish employers withhold A-tax and the labour market contribution from salary and report payroll through Danish systems. Danish employers withhold A-tax and the 8% labour-market contribution (AM-bidrag) from salary where applicable and report payroll through Danish tax systems. From 2026, individuals start paying AM-bidrag from the calendar year in which they turn 18.

Employers should also budget for statutory labour-market schemes collected through ATP Samlet Betaling, including ATP Livslang Pension, AUB, Barsel.dk, occupational injury-related schemes and other statutory contributions where applicable. The exact cost depends on employee hours, status and scheme rules.

Pension obligations

ATP Livslang Pension is Denmark’s statutory supplementary labour-market pension for employees who meet the coverage conditions. Contributions are shared between employer and employee, with the employer normally paying two thirds and the employee one third.

Many Danish employees also receive occupational pension contributions through collective agreements or employment contracts, often materially higher than ATP alone. For professional energy and engineering roles, pension expectations should be benchmarked against the market, role level and any applicable collective agreement context.

Immigration and work authorization

EU, EEA and Swiss nationals can generally work in Denmark under free-movement rules, subject to registration requirements where relevant. Non-EU nationals normally need the correct work and residence permit before starting work.

SIRI administers several employment routes. The Pay Limit Scheme is commonly used where the offered salary is above the annual threshold and other conditions are met. From 1 January 2026, SIRI lists the Pay Limit Scheme minimum annual salary at DKK 552,000. Salary must normally be paid to a Danish bank account, employment must be on Danish terms, and SIRI may assess whether pay corresponds to Danish standards.

Other routes may include the Supplementary Pay Limit Scheme and Fast Track Scheme. They may also include the Positive Lists for higher education and skilled work. Eligibility depends on the employer, role, qualifications, salary and labor-market conditions. Some routes require at least 30 hours of work per week.

Denmark employers should monitor the following during 2026:

  • Pay Limit Scheme threshold. From 1 January 2026, the Pay Limit Scheme threshold is DKK 552,000, and salary levels should be checked before any work permit filing or renewal.
