Why the position exists

The sophistication of the contracts required to execute the project requires a specialist for the identification and management of contract and commercial related issues. This position will help interface with legal, project controls and project management in the timely identification of contract and commercial issues across all levels of the EPC Contract with Contractor for the Project Management Team. This position reports directly to the Project Commercial Manager, with interface of the Project Director as needed.

Objectives of the position


Ensure everyone goes home safely every day. Ensure all contractors comply with all occupational and environmental regulations and project procedures. Ensure these requirements are included in all contracts, with appropriate enforcement provisions.
Supports detailed analyses of project schedule delays, cost overruns, productivity, contracts, change orders and other issues related to design and construction.
Working with the Project Commercial Manager, develop the appropriate level of knowledge as to the construct and compliance provisions of the EPC Contract with Contractor.
Maintain documentation to ensure timely compliance with all provisions of the EPC contract by the Contractor.
Assist in the management of potential change orders brought forward by the Contractor.
Assist the Commercial Manager by providing commercial assurance to the project.

Ensure the terms of the Contractor EPC Contract are respected.
Have the estimating acumen and ability to investigate merits of potential change orders through researching project contemporaneous documentation.
Provide recommendations to the Commercial Manager regarding active management of risk and risk mitigation measures.
Support the Commercial Manager in the handling of commercial administration matters.
Maintain a positive environment for discussion of commercial matters with Contractor and within the PMT.
Minimize the cost and schedule impacts of change orders based on application of the contract requirements, terms and provisions.
Assist in the compliance monitoring in processing claims resulting from an insurable event.
Work proficiently with engineering, project and other technical managers to understand engineering and construction activities and issues and apply those to the EPC contract provisions to assess and resolve concerns related to contract compliance.

Business Environment
The project is well into the Execution Phase and will deliver in accordance with the terms and conditions of the Expansion Project work program and budget. The project will begin commissioning in 2018 and shall begin to achieve operational status in 2019.

Key Systems and Processes
Knowledge of EPC contracting environment.
Ability to develop documentation to assist in the negotiation of change order cost and schedule impacts.
Manage risk and external compliance requirements. Champion pro-active management of risks and opportunities.
Facilitate risk workshops and subsequent compilation and maintenance of the risk register.
Provide recommendations to the Commercial Manager on the implementation of risk mitigation strategies.
Prepare drafts of contract and risk related communications for the Commercial Manager.
Supports detailed analyses of project schedule delays, cost overruns, productivity, contracts, change orders and other issues related to design and construction.
Assists in the research and analysis of project cost records.
Assists in developing contractor production rates and costs using various software packages.
Assists with data gathering activities including document review and supervision, and quality control of data entry activities.
Demonstrates proper documentation of work product.
Prepares client communications (e.g., formal letters to the Contractor) for legal and project management review.
Assist in gather and analyzing information related to claims and actual or potential litigation arising from the project.
Review and resolve contract compliance tasks through company’s tracking database (TRAC).
 

Requirements

Three to Five years of experience in the construction/commercial claims evaluation (Field and/or Home office)
Strong proficiency utilizing Word and Excel
Strong oral and written communication skills

Proficiency at reading and understanding construction contracts
Efficient, flexible, creative problem solving skills, a high level of motivation, and excellent analytical and organizational skills
Willing to train the right candidate
Bachelor's degree in Civil, Mechanical, Industrial Engineering or Construction Engineering/Management preferred
